Welcome to LashMi.

These Terms & Conditions ("Terms") govern your access to and use of the LashMi website, including purchases of physical products, digital products, professional resources, and other products or services offered through LashMi LLC.

Throughout these Terms, "LashMi," "we," "us," and "our" refer to LashMi LLC, a Colorado limited liability company.

"You" and "your" refer to the individual, business, or other party accessing this website or purchasing from LashMi.

By accessing this website, creating an account, placing an order, purchasing or accessing a digital product, or otherwise using LashMi's services, you acknowledge that you have read, understood, and agree to these Terms and the policies incorporated into them.

If you do not agree, please do not use the website or purchase LashMi products or resources.

1. Professional Use & Eligibility

Certain LashMi physical products are professional beauty products intended for appropriately licensed or otherwise legally authorized beauty professionals.

Where a product is identified as For Professional Use Only, you represent that you possess any license, certification, training, authorization, or other qualification required to legally purchase and use that product in your jurisdiction.

LashMi may require customers to confirm professional status during checkout.

You are responsible for knowing and complying with the licensing, scope-of-practice, health, safety, sanitation, and other professional requirements that apply to you and your business.

Availability for purchase through this website does not mean that a product or professional activity is lawful or appropriate for every purchaser, license type, location, or circumstance.

You must be at least 18 years old or the age of legal majority in your jurisdiction to make purchases through this website unless otherwise permitted by applicable law.

2. Products & Product Information

LashMi offers professional lash products, supplies, digital systems, educational resources, and related merchandise.

We make reasonable efforts to provide accurate product descriptions, images, pricing, specifications, availability information, and instructions.

However, product packaging, appearance, formulation, labeling, specifications, manufacturer information, or other details may occasionally change without prior notice.

Product photographs and digital representations may vary slightly from the physical product due to lighting, screens, manufacturer changes, or other factors.

Customers are responsible for reviewing product descriptions, manufacturer instructions, professional-use requirements, ingredients or safety information when applicable, and other relevant information before purchase and use.

3. LashGod Products & Distributor Relationship

LashMi is a U.S. distributor of LashGod professional lash products.

LashGod product names, trademarks, logos, packaging, product descriptions, and other proprietary materials associated with LashGod remain the property of their respective owner(s).

LashMi's distribution of LashGod products does not transfer ownership of LashGod intellectual property to LashMi or to any purchaser.

Unless expressly stated otherwise, references to LashGod on this website identify products distributed or sold by LashMi and do not imply ownership by LashMi of the LashGod brand or its intellectual property.

Product performance, formulations, packaging, availability, and manufacturer specifications may be changed by the manufacturer.

For LashGod purchases outside the United States, customers should purchase directly from LashGod or an authorized distributor serving their region.

4. Orders & Acceptance

Submitting an order does not guarantee acceptance.

An order is considered accepted when LashMi processes or fulfills the order, provides digital access, or otherwise confirms acceptance.

LashMi reserves the right, to the extent permitted by law, to refuse, limit, or cancel an order for legitimate business reasons, including:

Suspected fraud or unauthorized payment activity
Pricing, listing, or technical errors
Inventory discrepancies
Product unavailability
Purchase quantities inconsistent with available inventory
Suspected unauthorized resale or redistribution
Suspected misuse of digital products
Failure to satisfy professional-use requirements
Violation of these Terms or another LashMi policy
Abusive, threatening, fraudulent, or unlawful conduct

If LashMi cancels an order after successful payment but before the affected products or digital materials have been fulfilled, the applicable amount will generally be refunded to the original payment method.

5. Pricing & Payment

Prices are displayed in U.S. dollars unless otherwise stated.

LashMi may change prices, promotions, shipping thresholds, bundles, discounts, or product availability at any time before an order is placed.

The price applicable to an accepted order is generally the price displayed at the time the order is submitted, subject to correction of obvious pricing or technical errors as permitted by law.

Payment must be successfully authorized before fulfillment.

Payments may be processed through Wix Payments or other third-party payment processors made available through the website.

LashMi does not directly control the processing practices, authorization decisions, or security systems of independent payment processors.

6. Sales Tax

Applicable sales tax may be calculated and collected at checkout based on the order, product type, delivery location, applicable tax rules, and the functionality of LashMi's e-commerce or tax-processing systems.

Customers remain responsible for any taxes, duties, assessments, or obligations legally imposed on them that are not collected by LashMi.

LashMi currently ships physical products only within the United States.

7. Inventory, Availability & Purchase Limits

Physical inventory may be stocked in limited quantities.

Products displayed on the website may become unavailable before inventory information updates.

LashMi may limit purchase quantities when reasonably necessary because of product availability, freshness, professional-use restrictions, manufacturer limitations, suspected unauthorized resale, or other legitimate operational considerations.

Bulk and custom orders may be available by direct arrangement and may have different pricing, processing times, availability, or other terms disclosed at the time of ordering.

8. Shipping, Local Delivery & Pickup

Physical product fulfillment is governed by the Shipping, Local Delivery & Pickup Policy, which is incorporated into these Terms by reference.

That policy contains information regarding:

U.S. shipping
Processing times
Shipping methods
Tracking
Temperature-sensitive adhesives
Free local delivery eligibility
Local pickup
Incorrect addresses
Lost or damaged shipments
Carrier delays

By selecting a fulfillment method, you agree to the terms applicable to that method.

9. Returns, Refunds & Digital Delivery

Returns, physical-product issue resolution, store credit, refunds, digital delivery, and digital access are governed by the Returns, Refunds & Digital Delivery Policy, which is incorporated into these Terms by reference.

All physical product sales are final unless otherwise expressly stated by LashMi before purchase. LashMi does not accept ordinary returns or exchanges for change of mind, preference, ordering errors, or products no longer wanted or needed after fulfillment.

For verified incorrect, damaged, defective, or otherwise qualifying physical-product issues, LashMi's standard resolution will generally be correction, replacement, exchange, or LashMi store credit, depending on the circumstances and product availability. Refunds to the original payment method are generally not provided unless LashMi determines that a refund is appropriate or applicable law requires one.

Digital products are final sale once access has been provided, except where otherwise required by applicable law.

10. Digital Products

LashMi may sell digital products including, without limitation:

Client documentation systems
Intake and consent materials
Operational frameworks
Templates
Guides
Educational resources
Retention protocols
Business resources
Google Form structures
Editable or customizable documents
Digital products are licensed, not sold as intellectual property.

Purchasing a digital product gives you only the rights expressly granted under these Terms or any additional license terms displayed with the applicable product.

11. Digital Product License

Unless different written license terms are expressly provided for a particular product, purchase of a LashMi digital product grants the purchaser a:

limited, non-exclusive, non-transferable, revocable, single-business-use license.

This license permits the purchaser to use the purchased materials within the purchaser's own business and, where the product is specifically designed for customization, to replace designated business identifiers, placeholders, or other expressly editable information for authorized internal business use.

A purchase does not transfer:

Copyright
Ownership
Intellectual-property rights
Resale rights
Redistribution rights
Publication rights
Sublicensing rights

The license is granted to the purchasing business only.

If you operate multiple separate businesses or purchase materials for use by another business, additional licenses may be required unless LashMi expressly provides otherwise in writing.

12. Permitted Internal Use

Subject to these Terms and any product-specific instructions, an authorized purchaser may:

Download and store the purchased materials
Maintain reasonable backup copies for the purchasing business
Add or replace designated business identifiers where intended
Implement forms, policies, workflows, and resources within the purchasing business
Provide client-facing forms or information to that business's own clients when the product is expressly designed for that purpose
Use the materials internally with staff working on behalf of the licensed purchasing business when reasonably necessary for that business's operations

Permitting staff to access materials for the purchasing business's internal operations does not grant those individuals a separate license to copy, retain, distribute, use, or adapt the materials for another business or independent practice.

13. Prohibited Digital Product Use

Unless LashMi gives express written permission, you may not:

Resell, redistribute, sublicense, or give away LashMi digital products
Share purchased files with another independent artist or business
Upload purchased materials to shared resource libraries for use by unlicensed businesses or individuals
Upload or distribute materials through courses, memberships, educational programs, schools, mentorships, or training programs
Sell or distribute LashMi materials through template marketplaces or other platforms
Reproduce or repackage LashMi materials for commercial distribution
Publish substantial portions of purchased materials publicly
Remove ownership or copyright notices for the purpose of misrepresenting authorship
Claim LashMi's original materials as your own original proprietary work
Use LashMi materials to create substantially similar competing templates, documentation systems, resources, or products for resale or redistribution
Transfer your license to another person or business
Circumvent technical or access controls used to protect digital products

Unauthorized sharing or distribution may result in termination of access or license rights and may subject the responsible party to remedies available under applicable law.

14. Intellectual Property

Unless otherwise stated, the LashMi website and LashMi-created materials, including text, graphics, logos, branding, layouts, original photographs, digital products, documentation systems, templates, frameworks, educational resources, and other original content, are owned by or licensed to LashMi LLC and are protected by applicable intellectual-property laws.

Nothing on this website grants a license to use LashMi intellectual property except as expressly provided in these Terms or in writing by LashMi.

LashMi, associated LashMi branding, and original LashMi materials may not be used in a manner that falsely suggests affiliation, sponsorship, endorsement, authorship, or authorization.

Third-party names, trademarks, products, photographs, and other materials remain the property of their respective rights holders.

15. Copyright & Intellectual Property Concerns

LashMi respects the intellectual-property rights of others. If you believe material available through the LashMi website infringes your copyright or other intellectual-property rights, please follow the reporting procedure provided in our Copyright & Intellectual Property Policy.

That policy addresses intellectual-property ownership, permitted use, third-party materials, and infringement reporting. It does not expand the license granted to purchasers of LashMi digital products.

16. Professional Product Use & Safety

Professional beauty products must be used according to applicable manufacturer instructions, professional standards, training, licensing requirements, and appropriate safety practices.

You are responsible for determining whether a product is appropriate for:

Your professional qualifications
Your work environment
Your client's circumstances
Your local laws and regulations
Applicable contraindications or sensitivities
Your temperature, humidity, storage, and application conditions

Do not use professional products outside your lawful scope of practice or contrary to manufacturer instructions.

Where patch testing, ingredient review, health screening, ventilation, protective equipment, sanitation, or other precautions are appropriate, the purchaser or professional is responsible for implementing them.

17. Lash Adhesive Performance

Professional lash adhesive performance depends on many factors, including temperature, humidity, storage, product age, handling, preparation, technique, curing conditions, natural lash condition, client behavior, and environmental conditions.

Product descriptions, recommendations, studio experience, or educational information provided by LashMi do not guarantee identical retention or performance for every artist or client.

Customers are responsible for following manufacturer storage and usage instructions and evaluating their own environment and application practices.

18. Educational & Operational Information

Information provided through LashMi's website, product descriptions, inserts, guides, digital systems, social content, or other resources is provided for professional educational and operational purposes.

LashMi's experience, recommendations, systems, or examples do not replace:

Professional licensing requirements
Manufacturer instructions
Legal advice
Tax advice
Accounting advice
Medical advice
Insurance advice
Advice from another appropriately qualified professional where needed

You remain responsible for decisions made within your own professional practice or business.

19. New Client Document System & Legal Disclaimer

Certain LashMi digital materials, including the LashMi New Client Document System, may identify a documented history of attorney drafting or review.

Where the applicable product page states that materials were originally drafted or reviewed by an attorney on February 5, 2019, that statement refers only to the specific documentation and historical legal review identified for that product.

It does not mean that:

LashMi currently provides legal services
The original attorney represents the purchaser
The materials are automatically compliant in every state or jurisdiction
Future edits, purchaser modifications, or changing laws have been reviewed or approved by that attorney

LashMi LLC is not a law firm and does not provide legal advice. Purchase or use of LashMi materials does not create an attorney-client relationship.

Laws, regulations, licensing rules, consent requirements, privacy requirements, enforceability standards, and business circumstances vary by jurisdiction and may change.

Purchasers are responsible for determining whether materials are appropriate for their own business and location.

Any substantive legal modification or adaptation should be reviewed by the purchaser's own qualified legal counsel.

20. No Guarantee of Results

LashMi may share product experiences, techniques, recommendations, examples, educational information, business frameworks, or other information based on actual professional experience.

Individual results vary.

Client outcome
Product performance under every condition
Revenue or profitability result
Business outcome
Client acquisition or retention result
Legal outcome
Protection from disputes or liability
Regulatory or licensing outcome

Past experience or results do not guarantee future outcomes.

21. Website Use

You agree to use the LashMi website only for lawful purposes.

You may not knowingly:

Interfere with the operation or security of the website
Attempt unauthorized access to website systems or customer accounts
Introduce malicious code or harmful technology
Scrape, copy, or systematically extract protected website content for unauthorized commercial purposes
Use the website to commit fraud or unlawful activity
Impersonate another person or business
Attempt to circumvent purchase restrictions, access controls, or digital-product protections

LashMi may restrict access when reasonably necessary to protect the website, customers, intellectual property, or business operations.

22. Customer Accounts

If customer accounts are available, you are responsible for maintaining the confidentiality of your login information and for activity occurring through your account.

Please notify LashMi if you reasonably believe your account has been accessed without authorization.

LashMi may suspend or terminate accounts used in violation of these Terms.

23. Reviews, Feedback & User Submissions

If LashMi allows customers to submit reviews, testimonials, photographs, comments, feedback, or other content, you represent that you have the right to submit that content and that it does not knowingly violate another person's rights or applicable law.

You remain the owner of content you submit.

By voluntarily submitting content for publication through LashMi's website or requesting that LashMi feature it, you grant LashMi a non-exclusive, royalty-free license to display, reproduce, and use that content for the purpose reasonably associated with the submission, including operating and promoting LashMi, unless otherwise agreed.

LashMi may decline or remove content that is unlawful, fraudulent, abusive, misleading, infringing, irrelevant, or otherwise inappropriate for the website, subject to applicable law.

24. Third-Party Services & Links

The LashMi website may contain links to or rely upon services provided by third parties, including Wix, payment processors, USPS, LashGod, social-media platforms, and other service providers.

Third-party websites and services operate under their own terms, policies, availability, and practices.

LashMi does not control independent third-party services and is not responsible for their content, privacy practices, availability, or actions except to the extent responsibility cannot legally be excluded.

A link to a third-party website does not necessarily constitute endorsement of all information, products, or services available through that website.

25. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the LashMi website, digital resources, and information are provided on an "as available" basis.

Except for warranties expressly provided by LashMi, a manufacturer, or applicable law, LashMi disclaims warranties that may lawfully be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot legally be excluded or limited.

26. Limitation of Liability

To the fullest extent permitted by applicable law, LashMi LLC and its owners, officers, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of the website, products, digital materials, or services.

Where liability may lawfully be limited, LashMi's aggregate liability arising from a particular purchase will not exceed the amount actually paid to LashMi for the product or order giving rise to the claim.

These limitations do not apply where prohibited by law and do not limit liability that cannot legally be waived or restricted.

27. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, or reasonable expenses arising from your unlawful use of the website, unauthorized redistribution or misuse of LashMi intellectual property, violation of these Terms, or violation of another person's rights.

This provision is not intended to require a consumer to indemnify LashMi for LashMi's own unlawful conduct, negligence where such limitation is prohibited, or obligations that cannot legally be transferred.

28. Privacy

Your use of the website is also subject to the LashMi Privacy Policy.

The Privacy Policy explains how personal information may be collected, used, disclosed, and otherwise handled in connection with the website and LashMi's business operations.

29. Electronic Communications

By providing an email address, telephone number, or other electronic contact information in connection with an order, you consent to receive transactional communications reasonably necessary to process and support that order, such as:

Payment notifications
Fulfillment updates
Shipping or delivery notifications
Pickup coordination
Digital product access

Transactional communications are separate from optional promotional marketing.

Marketing communications will be handled according to applicable law and LashMi's Privacy Policy, and customers may unsubscribe from promotional email communications using the method provided in those communications.

Nothing in this section permits LashMi to retroactively remove rights already granted for a completed purchase in violation of applicable law or the terms applicable to that purchase.

31. Changes to These Terms

LashMi may update these Terms periodically to reflect changes in products, technology, business practices, legal requirements, or website operations.

Updated Terms become effective when posted unless another effective date is stated.

For completed purchases, the terms in effect when the order was placed will generally govern that transaction unless applicable law requires otherwise.

Continued use of the website after updated Terms become effective constitutes acceptance of the revised Terms for future use and transactions.

32. Governing Law

These Terms and disputes arising from them are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except where applicable federal law or non-waivable law provides otherwise.

Nothing in these Terms deprives a consumer of protections or rights that cannot legally be waived under applicable law.

33. Dispute Resolution

Nothing in this section prevents either party from exercising rights or remedies available under applicable law.

These Terms do not currently require binding arbitration or waive any right to a jury trial.

34. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent reasonably necessary where permitted, and the remaining provisions will continue in effect.

35. No Waiver

Failure by LashMi to enforce a provision of these Terms on one occasion does not waive the right to enforce that provision or another provision in the future.

36. Entire Agreement

These Terms, together with the policies and product-specific terms expressly incorporated by reference, constitute the agreement between you and LashMi regarding use of the website and purchases through it, except where a separate written agreement expressly applies.

If product-specific written terms directly conflict with these general Terms, the more specific terms will control for that product to the extent of the conflict.
